Terms of Use & Premium Terms

1. Scope

These Terms of Use apply to the use of the DEV1LSCLUB Discord community, the website dev1l.de, and to digital premium access, premium keys and associated community features.

By purchasing, redeeming or using a premium key you accept these terms.

2. Description of services

DEV1LSCLUB is a Discord community with activity systems, rank and role progression, community features and digital entertainment functions.

Premium keys can be purchased on dev1l.de. After successful payment via Stripe, a premium key is generated and displayed under "My Keys" (/en/account/keys/). The key can then be redeemed in the Discord server using /premium redeem [key].

A premium key unlocks digital premium benefits for the specified period. Depending on the package, this may include:

  • Premium role on the Discord server
  • Access to selected community areas
  • Community badges and profile benefits
  • Rank and access perks
  • Convenience features within the community

The exact scope of services is set out in the relevant product description on the website or at checkout.

3. Premium keys and duration

Premium keys are digital access codes generated after successful payment via Stripe and made available in the account area.

Depending on the product, a key provides one of the following durations from the time of redemption:

  • 7 days Premium
  • 30 days Premium
  • 90 days Premium

A key remains valid until redeemed, unless the server rules provide otherwise. The duration begins when the key is redeemed in the Discord server.

Once the period expires, premium status ends automatically unless a new key is redeemed or a new premium access is purchased.

4. No sale of community currencies

No internal community points, coins, server points or comparable community currencies are sold via the website or the Stripe checkout.

Only digital premium access or a premium key for community benefits is sold.

5. Community features and internal systems

Internal community points, roles, badges or similar features are intended solely for use within the DEV1LSCLUB community. They are not transferable, not tradable and cannot be converted into money, vouchers, goods, services or other real-world benefits. Trading outside the community rules is prohibited.

6. Community games and virtual currency

DEV1LSCLUB offers community games for entertainment, including DEV1LBlackjack and DEV1LPrincess. All games run exclusively on the basis of the internal virtual currency DevilCoin.

The following rules apply to all community games:

  • All gameplay uses virtual DevilCoins only.
  • DevilCoins have no monetary value and cannot be paid out.
  • There is no way to convert winnings into real money, vouchers or any other real-world value.
  • The games are for community entertainment only and do not constitute gambling in the legal sense.
  • No real-money wagering is possible or intended.

Rate limits and anti-abuse mechanisms protect fair gameplay and prevent manipulation, automation or misuse of the game systems. Violations may result in suspension from community games or exclusion from the community.

7. Unauthorised transfer and external trading prohibited

The transfer, sale or unauthorised trading of premium keys, community roles, accounts or other internal server features to third parties outside the intended community use is prohibited.

Violations may result in a ban, removal of roles or exclusion from the community.

8. Provider

The operator and contracting party is the operator of DEV1LSCLUB named in the Imprint.

9. Community rules and user obligations

Users must hold a Discord account and comply with the server rules, Discord Terms of Service and applicable law.

The following are prohibited in particular:

  • Fraud and manipulation
  • Exploiting bugs
  • Manipulating bot functions
  • Multi-account abuse
  • Evading bans
  • Unauthorised transfer or trading of keys or community features
  • Harassment, threats or harmful behaviour towards other users
  • Chargeback abuse or payment fraud

10. Bans and exclusions

In the event of violations of these Terms of Use or the server rules, we may warn users, temporarily ban them or permanently exclude them from the community.

If a user is excluded due to serious rule violations, fraud, abuse or chargeback fraud, there is no entitlement to continuation of premium access.

Statutory consumer rights remain unaffected.

11. Availability and changes

We strive for stable operation of the website, the Discord server and the bots. However, uninterrupted availability cannot be guaranteed.

Maintenance, technical issues, Discord outages, security measures or server changes may cause interruptions.

We reserve the right to adjust community features, roles, bot functions or premium benefits, provided the essential character of the purchased premium access is not unreasonably impaired.

11a. Third-party platform Discord and force majeure

DEV1LSCLUB is a community service operated on the Discord Inc. platform. The delivery of our services is technically and structurally dependent on the availability, policies and decisions of Discord Inc.

We are not responsible or liable for:

  • Outages, disruptions or restrictions of the Discord platform
  • Changes to the Discord API, features or terms of service made by Discord Inc.
  • Actions taken by Discord Inc. against our server, bots or accounts
  • Temporary unavailability of the server due to technical issues on Discord's end
  • Force majeure events outside our control

Temporary outages or disruptions caused by Discord do not give rise to a right of refund or duration extension, provided normal operation is restored within a reasonable time.

In the event of a permanent, unforeseeable shutdown of the DEV1LSCLUB Discord server by Discord Inc. (e.g. a platform decision or force majeure), Section 13 on pro-rated refunds applies.

12. Payments

Payments are processed via Stripe. We do not store card data.

The prices stated at checkout apply at the time of purchase. Purchases are one-time payments unless recurring payment is explicitly stated at checkout.

13. Refunds

Refunds are made in accordance with statutory provisions and on a case-by-case basis.

A refund may be excluded in particular if a premium key has already been fully redeemed and the digital service has already been provided, insofar as this is permitted by law.

Statutory rights of withdrawal remain unaffected.

Refund due to permanent server shutdown by Discord

Should the DEV1LSCLUB Discord server be permanently suspended or shut down by a decision of Discord Inc. beyond our control, such that the purchased premium benefits can no longer be accessed, members with remaining runtime may request a pro-rated refund for unused days.

Temporary outages, disruptions or suspensions that are resolved within a reasonable time do not give rise to a refund entitlement.

To request a refund in such cases, please contact us by email at admin@dev1l.de. Please include your Discord username, premium key and date of purchase. We review each request individually. Refunds will be processed — where technically possible — via the original payment method (Stripe).

14. Minors

Purchasing premium access is only permitted if you are of legal age or have the consent of your legal guardian.

15. Liability

We are fully liable for intent, gross negligence and injury to life, body or health.

For minor negligent breaches of material contractual obligations, liability is limited to foreseeable, typical contractual damage.

Liability under mandatory statutory provisions remains unaffected.

16. Privacy

Information on the processing of personal data can be found in our Privacy Policy.

17. Changes to these terms

We may update these Terms of Use where technical, legal or organisational requirements change.

For premium access already purchased, the terms agreed at the time of purchase apply, unless compelling reasons require a change.

18. Final provisions

German law applies, unless mandatory consumer protection provisions of your country of residence provide otherwise.

Should any provision of these Terms of Use be invalid, the validity of the remaining provisions shall be unaffected.

Right of Withdrawal

Right of withdrawal

If you are a consumer, you generally have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the date the contract is concluded.

To exercise your right of withdrawal, you must inform us by means of a clear statement that you wish to withdraw from the contract.

You may use the model withdrawal form below for this purpose, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send the notice of withdrawal before the withdrawal period expires.

Consequences of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you promptly and no later than 14 days from the date we receive notice of your withdrawal.

We will use the same means of payment for the reimbursement as you used for the original transaction, unless expressly agreed otherwise. You will not incur any fees for this reimbursement.

Start of digital service before the end of the withdrawal period

A premium key or premium access is a digital service for the DEV1LSCLUB Discord community.

If at the time of purchase you expressly agree that the premium service begins immediately after purchase or key redemption, and we begin providing the service, this may affect your right of withdrawal.

For digital content not supplied on a physical medium, the right of withdrawal may lapse early under the statutory conditions if you expressly agree that we begin performance before the withdrawal period expires and you confirm that you are thereby losing your right of withdrawal.

Recommended consent before activation

Before immediate activation of a premium key, the following confirmation may be required:

"I expressly agree that the digital Premium service begins immediately after purchase or after redeeming the key. I acknowledge that my right of withdrawal may lapse early under the applicable legal conditions, or that I may owe compensation for services already rendered in the event of withdrawal."
